Why DNA testing?

Although surrogacy is legal in Australia, many couples who seek surrogacy treatment opt to have this done in other countries. Due to the competitive pricing offered, many couples in fact have their surrogacy treatment carried out in Australia (although other countries such as Georgia, Russia, Thailand and Ukraine are also popular choices).

Once the child is born, the commissioning parents bring the child back to Australia. However, the fact that the child was born outside the Commonwealth of Australia can pose certain challenges, especially in view of the child’s claim to Australia citizenship. Our test results can help support citizenship by descent applications by proving relationship as per Australia legislative requirements. In cases of children born from any type of Assisted Reproductive Technology a DNA test result is strongly suggested in order to provide conclusive evidence of a biological relationship, – without such proof no Australia visa can be issued.

Procedure for Surrogacy DNA Testing

The intended / commissioning parents must apply for the child’s passport or visa. All applications must be submitted to and will be processed by the DIAC (The Department of Immigration and Citizenship) with the applicants incurring all the costs entailed. The department will issue a case number and DNA sample collection will be organized.

Samples will be collected by a nominated doctor, referred to as a panel doctor. The child is often sampled in the country of birth (usually at an Embassy or High Commission). The Australia parent must be sampled in Australia Once DNA samples are received for the child and the alleged parents, DNA testing can commence.

Types of surrogacy and their impact on Citizenship

Traditional surrogacy uses the egg of the surrogate mother; the surrogate mother is artificially inseminated with the father’s sperm. In this case, the mother is biological related to the child and is by all means, the child’s biological mother (although she will legally relinquish all her rights and obligations towards the child in favour of the commissioning parents once the child is born). This fact that the surrogate is the biological mother means that the commissioning parents will need to undergo additional steps to adopt the child.

Gestational Surrogacy uses the egg and sperm from the commissioning parents. The egg and sperm are fertilized in a laboratory by a process known as in-vitro fertilization or IVF. Due to the fact that IVF is involved in gestational surrogacy, the procedure is considerably more costly than traditional surrogacy. However, the surrogate mother’s role is simply that of carrying the child to term and she has no genetic relationship to the child. The child is the biological offspring of the commissioning parents.

Applicable Laws in Australia

Note that certain Australia states and territories have certain laws which make it illegal for people residing within that state or territory to seek any type of commercial surrogacy.
